In this article the author summarizes the legal resources available to water suppliers under the Comprehensive Environmental Response, Compensation, and Liability Act, commonly known as the Superfund, to recover costs resulting from contamination of water sources by hazardous substances. Private parties, such as water suppliers whose property has been damaged, may bring suit against those responsible for the release of hazardous substances to recover the cost of remedial actions or short-term cleanup of spills. Descriptions of court rulings are presented, and procedures for filing claims against those responsible for contamination are discussed. (Abstract also appears in Spanish) Includes 4 references.
